General terms of service
In a perfect world, there would be no need for terms & conditions, but life happens. Luckily, you won't find any inscrutable, onerous, and impenetrable jargon here. Throughout this document, House Digital will be referred to simply as "I", and the client will be referred to as "you."
I accept payment by credit card.
My design fees are non-refundable. However, I stand behind my work and will work until you are satisfied (within the scope of the project). The Deposit to book your project is good for up to 1 calendar year.
After the launch of your website, you will receive 30 days of unlimited website support. Beyond that, website maintenance is charged at my regular hourly rate.
I work closely with my clients. Usually, this means working one-on-one together. If you team members, I am happy to collaborate with up to 1 team member in addition to yourself. If for some reason you would like me to work within a team environment, I consider these projects on a case by case basis, and I may charge a 25% additional fee in such cases.
EMAILING, CALLING, AND TEXTING
Most communication between us will happen 1) by phone during our scheduled calls 2) through email, and 3) through the Trello task management tool. I don’t text about projects or receive unscheduled phone calls. I’m usually able to respond to emails within 24 business hours. Email hours: Monday through Friday.
OWNERSHIP OF CONTENT
Over my time working with designers, there are particular phrases I crafted that I believe best communicate a particular idea. Because many designers work similarly, there is often only one best way to say something, especially when it comes to describing services. Thus, for text that I write for you for your new website I reserve the right to use that language with other clients. Here's an example: “You will benefit from our relationships with vetted industry experts and our access to “trade-only” vendors for competitive pricing on premium finishes and furnishings.” This one phrase is the result of a probably 20-30 revisions, and it's a phrase that applies equally to almost every single interior designer. No need to recreate the wheel. At the end of the project, I’ll create a document that shows any content I reserve the right to use with other clients and any content that belongs exclusively to you.
DISPLAYING DESIGN WORK
I retain the right to display and speak about my work on your website on my website and social media. If this is an issue for you, please let me know and we can discuss.
You are ultimately responsible for the storage of your own files, including photos and text.
PARAMETERS OF SQUARESPACE
I am a Squarespace expert and can push the platform to its limits. However, I cannot guarantee unlimited customization beyond the parameters of the Squarespace platform. However, rest assured: for portfolio style websites, Squarespace is great.
Because issues in design can be unpredictable, I do not guarantee any schedule of work, though I can tell you most projects last between 6-12 weeks from start to finish.
In the case of a complete website design, if for some reason the website has not been launched after 3 months from the start of the project due to a delay or unexpected circumstance on your part, I reserve the right to charge an hourly rate to finish the project.
RESPONSIBILITY FOR PERFORMANCE OF YOUR BUSINESS
I provide tools that are intended to help you grow and build your business. However, you are ultimately fully and exclusively responsible for your own business performance and client satisfaction.
RIGHT TO TERMINATE PROJECT
If for some unlikely but legitimate reason I am having difficulty working with you, including but not limited to breach of agreement as described in this document, I reserve the right to terminate the project by giving you written notice. In such case, you will not be required to pay any further fees. However, I reserve the right to keep all payments made to date, without refund. Of course, I will attempt to find a solution with you before resorting to ending the project. If for any reason you want or need to end the project, you have the right by giving me written notice. Once the project is terminated, no further payments will be due.
